What Are State Administrative Agencies?

Although manufactured homes are legislated by Housing and Urban Development Administration (the Federal Government), in most cases their installations and governance are over overseen by "State Administrative Agencies".   These SAA's control all manufactured housing issues, installation and governance on a state-by-state basis.  For a complete listing: http://www.hud.gov/

California:  Titling Information

In California, HCD is both the titling and registration agency as well as the building oversight agency with respect to determining a permanent foundation.   The detitling document is called a 433A and it is recorded once a permit has been pulled at the appropriate building jurisdiction presenting engineered plans for a state approved permanent foundation system.  Once issued, the foundation system is installed and inspected by the building official and the 433A is recorded and then detitled by sending documentation to Sacramento.     No matter what type of foundation is supporting a manufactured home, without a 433A, the foundation does not technically meet California state codes.   Generally speaking the title company will not issue title insurance without a 433A.

Michigan
Michigan:

Affidavit of Affixture for Michigan and the process for detitling.   As I thought the homeowner needs to participate in the process.  This home is on a full basement so she may have to go to the building department for the foundation compliance.   Or if they will allow the engineer's certification to provide proof, we can certainly do this.  At the bottom, the agency in charge of manufactured homes is listed.

To file the affidavit with the Michigan Bureau of Construction Codes (the agency that handles the process within DLEG separate and outside of Secretary of State) and record it with the Register of Deeds it to cancel the title use the following steps:

  • Fill out original Affidavit of Affixture with the property description (see web site/link address below for the most recent copy of the form).
  • The home owner signs their signature(s)
  • Notarize the original
  • Lien holders must sign off (releasing lien interest) if previously listed on the title
  • Return original to the Michigan Bureau of Construction Codes (address on affidavit) (517) 241-9317 for filing along with the original Certificate of Origin that comes with a new home or the Certificate of Title along with the $90.00 fee made payable to the State of Michigan. (DLEG will accept a Certificate of Title that has been assigned from the original owner to the purchaser that is filing the Affidavit)
  • When the Affidavit of Affixture is returned from DLEG, send the "filed" stamped copy of the Affidavit (with attached copy of the Certificate of Origin or Certificate of Title) to the Register of Deeds for recording.
      • File the Affidavit with the BCC. After it is executed and returned by the BCC, record the Affidavit with the Register of Deeds. Include a one paragraph letter signed by the home owner stating "once the Affidavit canceling the title has been filed to return it to the retailer, bank, Title Company", or who ever plans to complete the recording process with the county Register of Deeds.

      If you do not attach a letter requesting that it be returned to an entity other than the home owner, the default recipient of the "filed" copy is the home owner. You can write your own verbiage section on the second page of the affidavit stating where you would like the original Bureau stamped Affidavit to be returned or in the case of Register of Deeds where it is to be returned after it is recorded. Or to get the same result attach a letter signed by the homeowner requesting that the original with the proof of filing stamp be returned to a different entity or address than the owner.

      In instances where is no title, Certificate of Origin, court order, or surety bond, or the originating lender has lost the title or out of business, the Bureau has included within the new rules additional options for proof of ownership (see below). These optional procedures include a paper trail of documentation that proves ownership of the home and release of lien. Examples of what will be expected may include; documents such as a previous thank you letter announcing the pay off of the loan that mentions the loan account number or has the VIN number in the letter, and proof of real-estate taxes paid with a valuation notice that includes the home as part of the real-estate, home owner insurance paid receipts, local taxes proof of payment, and other proof documents.

Mississippi Titling:

Mississippi: A manufactured home owner  who also owns the land on which the home is located has the option of declaring whether the home is to be classified as personal or real property. To be classiï'ed as real property, the wheels and axles must be removed and the home must be anchored and blocked in accord with rules adopted by the commissioner of insurance.  A certiï'cate that the home has been classiï'ed as real property is then recorded in the county land records, and the home's certiï'cate of title may be sent to the state tax commission for cancellation.The home is then treated as real property for
purposes of ad valorem taxation, and a security interest in the home and land may be obtained through the use of a mortgage or deed of trust.

Conversion to Real Estate:
Every owner of a mobile/maufactured home is required to obtain a Nebraska Certificate of Title prior to affixing the home to real estate.  If a mobile/manufactured home has been affixed to real estate and a Nebraska Certificate of Title was not issued before it was affixed, the owner shall apply for and be issued a Certifiate of title at any time for the sole purpose of surrendering such title for cancellation.
In order to procure a loan, a manufactured home must be titled as real property and not personal property.   If  the manufactured home is still titled as personal property, the following procedures for affixation will need to be followed.

If the Department of Motor Vehicles issued the Certificate of Title, the Affidavit of Affixture for a Mobile Home with a Nebraska Certificate of Title will be filed at the
Department.

Along with the Certificate of Title, you must submit the following:

A completed Affidavit of Affixture for a Mobile Home with a Nebraska Certificate of Title. The Affidavit must be completed in whole with the correct and complete real estate legal description. All owners of the mobile/manufactured home and real estate must be listed. All owners of the mobile/manufactured home must sign and their signatures must be notarized. If there are more than two owners, an additional Affidavit must be attached.

Written permission for release of the lien and cancellation of the Certificate of Title from each lienholder duly noted on the Certificate of Title;

The appropriate fee. The fees are $5.00 per page and 50¢ per lot or section.

If the mobile/manufactured home has two vehicle identification numbers (two MSO's were provided when new), two Affidavits and two Certificates of Title shall be submitted.

If the Certificate(s) of Title has been lost, you must obtain a duplicate title and submit that along with the Affidavit.

Upon receipt of the Affidavit and Certificate of Title, the County Motor Vehicle Office or DMV will:

Cancel any liens of record on the Vehicle Title and Registration system; and

Forward copies of the Affidavit to:

Each of the financial institutions listed on the Affidavit (as notice of cancellation); and

Person/entity submitting the Affidavit.

Upon receipt of a copy of the Affidavit, the DMV will enter a “Cancelled – Real Estate” status onto the title record. This status will prevent the issuance of any duplicate or corrected titles. A subsequent new title will be allowed only upon presentation of an Affidavit of Detachment .

Once the affidavit has been filed with the County Motor Vehicle Office or DMV, the owner of the mobile/manufactured home may convey ownership only as a part of the real estate to which it is affixed.

If the owner of a mobile home does not currently hold a Certificate of Title, and cannot produce the proper evidence of ownership for issuance of a Certificate of Title, he/she may apply to the Department of Motor Vehicles for a Bonded Certificate of Title and upon issuance of the Bonded Certificate of Title the owner may surrender it to the Department of Motor Vehicles with an Affidavit of Affixture for a Mobile Home with a Nebraska Certificate of Title for cancellation.

New Mexico Titling:

A lender will require that your home be titled as real property.
The process of converting a manufactured home to real property involves three different departments;

Manufactured Housing Division of the New Mexico http://www.rld.state.nm.us/mhd/index.htm The most important and first step in this process is to have the home certified as having a permanent foundation by either a certified New Mexico Engineer or an inspector from the Manufactured Housing Division of the Regulation and Licensing Department.

A request form for a permanent foundation permit must be obtained from the New Mexico Manufactured Housing Division. A foundation design plan that meets the required standards of the division:
  • All plans must be approved by either the Division's Chief Inspector, or the assigned inspector for your area.
  • All new homes must be set according to the manufacturer's specifications.
  • Most manufacturer's include the Permanent Foundation requirements within their installation manuals.
  • Plans must be stamped by an engineer and have the words "PERMANENT FOUNDATION" printed on the plans.
  • The foundation must be done by a licensed contractor who is registered with Manufactured Housing Division.
  • Used homes must be set according to the Manufactured Housing Division's Rules and Regulations.
Foundation plans are brought into the Santa Fe or Albuquerque office. Two copies of the plans must be provided; one will remain with the inspector. A permit that will have the inspector’s name for this region and phone number will be issued. A pre-final (before concrete is poured) and a final physical inspection will be required. If obtaining a loan, do not wait until the end of the mortgage process. The permanent foundation inspection will require some time to complete due the shortage in inspectors.

The County Assessor will classify the manufactured home as real property when:
  • A request to change valuation status has been requested by the owner,
  • Tongue and axles have been removed,
  • The owner of the manufactured home owns the land, on which the unit is located, Title to the manufactured home has been deactivated in accordance with 18NMAC 19.3.1, by the department of Motor Vehicle,
  • Provide a copy of the permit issued by the Manufactured Housing Division with the signature of the state inspector or certified engineer,
  • Provide a copy of the on-site appraisal performed by an independent fee appraiser to affirm the first two conditions,
  • All prior and current taxes have been paid.
The Motor Vehicle Division will deactivate a title when:
  • The title is free and clear of all encumbrances,
  • The County Assessor certifies to the Division that, once the title is deactivated, the manufactured home will be taxed as real property,
  • The owner has signed the title application.
If obtaining a loan, take copies of the manufactured home permit certifying a permanent foundation, the County Assessors affirmation of real property classification and the deactivated title to your lending institution or title company.
